Your duty to make a fair presentation of the risk

When you take out or renew a commercial insurance policy you have a legal duty to make a fair presentation of the risk. That means disclosing everything you know, or ought to know after a reasonable search, that would influence an insurer's decision on whether to offer cover, on what terms, and at what premium — and doing so clearly and accessibly.

A reasonable search means asking the partners, directors and senior people involved in the business and its subsidiaries, not just answering from your own knowledge. The duty continues until the policy incepts, so if anything material changes before then, tell us.

If a fair presentation isn't made, an insurer may be entitled to alter the terms of the policy, reduce a claim payment, or in some cases avoid the policy altogether. If you're unsure whether something is material, tell us anyway or ask — that's what we're here for.

What the business does
The single most important answer on this form — it defines what the policy will and won't cover. Break it down by percentage of income, e.g. "Management consultancy 60%, training delivery 30%, expert witness work 10%". Estimate if you don't have historical figures.
Design and product supply are treated very differently by PI underwriters, so please tell us either way.

Guarantees, warranties and "fitness for purpose" promises usually fall outside PI cover.
Cover required
If a client contract sets a minimum, tell us what it is.
Current insurance
PI is claims-made, so continuity of cover matters. If you're not sure, leave it — we'll check your schedule.
Claims & circumstances
Dates, what happened, who was involved, amounts paid or reserved, and current status. A disclosed claim is nearly always easier to place than one an insurer discovers later.

Anything unusual about your business compared with others in your field, any further principals or contracts not listed above, and anything you're not sure whether to mention — mention it.
